A member of the Administrative Appeals Tribunal has expressed his enthusiasm online for another day of destroying Australia’s public safety by overturning decisions made by Home Affairs on visas.

AAT member Mark Leibenberg posted a lengthy tribute on Linkedin to undermining the integrity of Australia’s social fabric and immigration system, by giving visas back to criminals who have had their visas cancelled.

‘Blessed to have another day of subverting faith in Australia’s immigration and justice system by hearing sob stories from Sudanese criminals and giving them their 250th chance at recidivism,” Liebenberg wrote.

‘If Deng has lived here most of his life, been in and out of the justice system without ever bothering to apply for citizenship while being a complete shitstain on Australian society, then I’m proud to fight to take up his fight against racism and discrimination and his right to invade your home without consequence.”

Attorney-General Mark Dreyfus also said he was introducing legislation to jail any Australian that criticsed an AAT decision.

Possibly. The main use case for the AAT was also as a tribunal mechanism to contest decisions made under commonwealth law. Whilst migration and refugee cases get a lot of the spotlight, it is a review body for many bodies, Centrelink decisions feature highly too, Medicare etc…

Interestingly, the Migrstion Review Tribunal and Refugee Review Tribunal as they were previously known did not permit any additional material to be presented in their case but this changed after Rudd got in the first time.

Another element of the AAT is to prevent the Fed courts getting clogged up with reviews of administrative decisions…

Don’t get me wrong, some of the decisions coming out have been atrocious, but I don’t see this as a mechanism to subvert statutory authority as such…

A new mechanism needs to be developed then in order to provide appeals because as it currently stands it is deeply anti-democratic.

My understanding is that the AAT was originally brought in to harmonise immigration laws between the UN and other signatory nations, and that the broad brush that Whitlam implemented it extended the review process to all Federal Commenwealth decision making.

At the very least non-citizens DON’T have the same rights as citizens, and thus should be exempted from appealing to the AAT.

The US Republican party was a new party which elected Lincoln within a few years of its founding and dramatically changed the USA by winning the Civil War and abolishing slavery.

I’m not enough of a history expert to say whether a party 100 years older could have created changes as radical, but it seems less likely to me.

I agree – this is the way. It is also why PHON has been such a dissappointment and more than anything is playing the role of controlled opposition.

The first priority of any party that gets into power, in terms of first holding the balance of power, must use its power to expose the Lib/Lab duopoly.

They need to be ungovernable in that they cannot provide the Libs (as presumably this is the reactive side were a new party will emerge from) the opportunity to carry on as business as usual.

They need to be prepared to genuinely oppose any Lib policy that clashes with their own and force the Govt to time and again approach Labor.

Basically any new NEEDS to become the genuine Opposition, and if necessary force, election after election is the Govt refuses to accept the policy demands the new party are making.

Anyone cunning/devious/selfish enough to get into that position is doing it for the gain that they can achieve from it and isn’t going to throw it away by getting voted out a month after they get in by calling a new election.

The only true power independents with the balance of power have is to force a new election that is just as likely to see them voted out as the gov they are trying to bring down.

Policy does not require a vote of parliament and they don’t need to approach the opposition. Only law changes require the support of parliament. first day it started moving out of my kidneys was the most excruciating pain ever and i had to go to hospital to find out what the problem was / get pain killers but there has been minimal pain since, but its finally about to go and the pain is flaring up now

day 1 i’d say was like 9/10 now its about 4/10 today

The best that the world can hope for imho is a new cold war between the West and Russia, but this time around, thanks to the cultural wars and access to various strategic resources, I’m not sure the West is in nearly as strong a position as it was last time around

Ignoring the small issue that the US has exported a huge amount of its industrial base to China, and currently lacks the infrastructure to not only build 1/10th of the shipping tonnage that China can build, it would first have to rebuild the industrial capacity necessary to be able to rebuild the shipping industrial capacity it has lost.
